Terms of Use

These Terms govern your use of Murmur (the “Software”), provided by Eric S. By downloading, installing, or using Murmur, you agree to these Terms. If you do not agree, do not use the Software.

1. License

Murmur is free and open-source software, licensed under the MIT License. You may use, copy, modify, and distribute it under the terms of that license, a copy of which is included with the Software and in the source repository. These Terms supplement, and do not replace, the MIT License; in the event of a conflict regarding your rights to the source code, the MIT License governs.

2. How the Software works

Murmur captures microphone audio, transcribes it on your device, and simulates keystrokes to type the resulting text into whatever application is focused on your computer. You are solely responsible for where and how that text is delivered, including ensuring that the focused application, field, and context are appropriate. We are not responsible for text entered into an unintended field, application, or recipient.

3. No warranty

The Software is provided “as is,” without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Software will be accurate, error-free, secure, or uninterrupted, or that any transcription it produces will be correct.

4. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Eric S. be liable for any claim, damages, or other liability, whether in an action of contract, tort, or otherwise, arising from, out of, or in connection with the Software or the use of or inability to use the Software, including without limitation any loss of data, lost profits, or business interruption.

5. Third-party services

Murmur downloads speech-to-text models and application updates from third-party services (such as Hugging Face and GitHub). Your use of those services is governed by their respective terms and policies. We are not responsible for, and make no representations regarding, any third-party service.

6. Updates

Murmur may check for, download, and install updates in order to keep the Software current and secure.

7. Acceptable use

You agree to use Murmur in compliance with all applicable laws and not to use it to infringe or violate the rights of any third party.

8. Privacy

Your use of Murmur is also subject to our Privacy Policy.

9. Changes to these Terms

We may update these Terms from time to time. The effective date above will be updated, and your continued use of the Software after changes take effect constitutes acceptance of the revised Terms.

10. Governing law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts located in Ontario, Canada.
